Legal Expert (Intermediary Payment Services)

Overview
Responsibilities
Provide responsive, sound, coherent and consistent legal advice on regulatory and contractual issues relating to MDP's products, services and transactions, including but not limited to legal structuring, legal procedures for implementation, data governance and personal data protection, intellectual property, finance, tax and accounting, IT, technology systems, technology infrastructure and information security, marketing, advertising and signboard activities, and business policies and incentive or promotional programs.
Review and provide recommendations on legal aspects and considerations for the development and deployment of new products and services, as well as key business initiatives.
Advise on, draft and review system operating rules and standard contract templates for members, partners and other third parties within the scope of company-wide projects.
Establish, review and update internal rules, policies and guidelines in line with regulatory best practice and industry standards to manage legal and contractual risks.
Advise on identifying and providing solutions to handle legal, reputational and operational risks for MDP, including anti-money laundering and fraud risks, in relation to its products, services and transactions.
Act as the focal point for legal advice and communication with the Company's departments on matters within the assigned advisory areas.
Requirements
Key Skills
Bachelor's degree in Law or higher degree from a reputable university.
Minimum 8 years of legal experience, including at least 6 years in finance, banking, payments or corporate governance, or at least 4 years handling in-depth legal matters in the finance, banking or corporate practice of a reputable law firm.
For candidates holding a Master's degree or higher in law from a foreign university: minimum 6 years of legal experience, including at least 4 years in finance, banking or payments, or at least 3 years handling in-depth legal matters in the finance, banking or corporate practice of a reputable law firm.
Domain Expertise
Good understanding of Vietnamese laws and regulations on cashless payments, intermediary payment services, foreign exchange and anti-money laundering.
Good understanding of data governance, personal data protection, cybersecurity, information security and electronic transactions.
Good understanding of payment flows, including QR payments, instant transfers, online payments, card payments and cross-border payments.
Good understanding of switching, clearing, settlement, reconciliation and dispute handling mechanisms.
Familiarity with tiered information system security requirements and the PCI DSS standard.
Experience with bank partnership products, international card schemes or foreign payment system operators is preferred.
Analytics Experience
Strong analytical and critical thinking, with the ability to turn legal issues into practical business solutions.
Ability to present complex legal issues clearly and concisely to non-lawyers.

Good command of written and spoken English, including contract drafting and negotiation.
