Senior Legal Counsel

JOB PURPOSE:
The Senior Legal Counsel of Heineken Vietnam (the "Company") shall provide efficient and high-quality legal services to the Company.
The Senior Legal Counsel will be acted as trusted legal business partner for sales and marketing team ("Commerce") and shall be responsible for providing a broad range of legal advice and support to the Commerce, including with respect to commercial operations, to (1) enable the Company to avoid and manage legal risks and (2) ensure compliance of the Commerce's activities with Heineken's Code of Business Conduct and policies, applicable laws and regulations.
KEY RESPONSIBILITY:
Strategic Business Partnership: Serve as the primary legal business partner for Commerce, overseeing all legal issues related to their operations. This includes actively interacting with and engage senior management (MT and MT-1) to ensure legal strategies are seamlessly aligned with overarching business objectives.
Ethics and Compliance Leadership: Drive an ethical and compliant culture throughout the company. This involves fostering adherence to anti-trust, anti-corruption, and data privacy laws, as well as various group policies, regulations, and industry codes of ethics.
Commercial Legal Strategy &
Support: Advise on legal strategies and provide robust support for product claims, product liability, and competitor challenges and defenses. You'll proactively challenge unfair or non-compliant business practices by competitors.
Pragmatic Legal Solutions: Deliver pragmatic, commercially sound legal solutions and advisory to business stakeholders and senior management. This includes day-to-day support in drafting, reviewing, and negotiating a wide range of commercial contracts essential for daily operations.
Value-Driven Legal Services: Contribute significantly to achieving the Company's objectives by providing high-quality, solution-oriented, and cost-effective legal services.
Proactive Risk Management: Proactively identify, evaluate, and advise Commerce stakeholders on potential legal risks (prevention and management) and opportunities, ensuring informed decision-making.
Compliance &
Collaboration: Help ensure strict compliance with the Heineken Group's Code of Business Conduct and policies, fostering an environment of strong teamwork and collaboration across departments.
Legal Intelligence &
Training: Stay abreast of changes in laws and regulations impacting company operations. You'll effectively communicate these changes to relevant stakeholders and provide necessary training to business and support functions.
Team Leadership &
Development: Manage and mentor at least one team member within the Legal function, driving accountability and ownership to ensure high-quality legal support for business partners and other stakeholders, all while optimizing cost structures.
Ad-hoc Projects: Undertake other tasks or projects as assigned by the Head of Legal or Regional Legal Head.
REQUIREMENT:
Requires a law degree or LLM in commerce or economic law.
Lawyer qualification over 10 years legal experience, preferably solid in-house counsel experience with a multi-national FMCG corporation or a combination of experience as private practice attorney and as an in-house counsel.
Previous experience in an MNC or a highly complex organization, either in Commercial and/or Supply Chain &
Production domains will be preferred
Strong communication and stakeholder management capabilities, high level of collaboration and influence cross-culturally.
In-depth legal knowledge (including commercial law, corporate law, investment law, anti-bribery law, civil law, data privacy law, alcohol law, advertisement law and any other relevant laws and regulations).
Strong problem-solving, decision-making and risk assessment capabilities, with good judgment and commitment to delivering results.
Energizing and inspiring others to go beyond the norm and actively contribute to delivering critical commercial objectives.
